MEMORANDUM ORDER NO.   96 – 28

 

                 SUBJECT:    

GUIDELINES, TERMS AND CONDITIONS FOR

UPLAND AGRICULTURAL LIVELIHOOD PROGRAM

Pursuant to Executive Order Nos. 224 and 258, dated July 16, 1987 and July 10, 1995, respectively, “ VESTING ON THE NATIONAL POWER CORPORATION THE COMPLETE JURISDICTION, CONTROL AND REGULATION OVER WATERSHED  AREAS AND RESERVATIONS SURROUNDING ITS POWER GENERATING PLANTS AND PROPERTIES OF SAID CORPORATION ” and Ministry Order No. 83-01-13, dated November 22, 1982, the following guidelines, terms and conditions are hereby issued  for the information and guidance of all concerned:

 

SECTION 1.0      DEFINITION OF TERMS

1.0         UPLAND AGRICULTURAL LIVELIHOOD PROGRAM AGREEMENT – a contract entered 

              into by and between an individual/group forest occupant/s and the National Power Corporation,

              allowing the former the right to peaceful occupation and utilization over agriculture. The contract

              shall be non-transferable but in cases of death or incapacity, the same shall on to the grantee’s 

              next-of-kin.

2.0        AGREEMENT – formal or legal documents authorizing, directing or controlling specified activities in watershed reservations.

 

3.0        AUTHORIZED REPRESENTATIVE – officials from the Watershed Management Department or other agencies of the government authorized by

            the President, National Power Corporation or the Manager, NPC-WMD to perform certain administrative and/or other functions/matters relative to

            this guidelines, terms and conditions.

4.0        BONAFIDE RESIDENT – is a person who has continuously resided in the place for at least ten years upon approval of this Order.

5.0        FOREST PRODUCT – includes among others, timber, pulpwood, firewood, bark, tree top, rattan and other forest growth.

6.0        FOREST PRODUCT COLLECTION/GATHERING – includes cutting, collecting, gathering and transportation of forest products for commercial

             and other purposes.

7.0        CORPORATION – National Power Corporation

8.0        OCCUPANT – refers to any person or group of persons, who in any way occupy, use or develop watershed reservations or derive benefits

             therefore.

9.0         NPC-WMD – Watershed Management Department of National Power Corporation

10.0     SALT – a diversified farming system of growing field and permanent crops in 3-meters to 5-meters wide bands between contoured rows of nitrogen

            fixing trees.

11.0     UPLAND AGRICULTURE – the cultivation or raising of corn, rice, vegetable and other agricultural crops on sloping or upland areas.

12.0     WATERSHED – a land area, including all the surface, geological or other resources therein, bounded by a topographic divide, drained by a

           stream or other bodies of water (perennial, intermittent or ephemeral ) and may form part of a larger complex with pre-established physical

            or land boundaries.

SECTION 2.0      SCOPE  

Authority to develop and manage “Upland Agricultural Livelihood Program” may be issued within the watershed areas/reservations covered by EOs 224 and 258. the authority may be conducted within titled lands, areas covered by tax declarations, alienable and disposable land or public lands inside the reservation not scheduled for reforestation within the next five years from the date of issue of authority.

SECTION 3.0      UPLAND AGRICULTURAL LIVELIHOOD PROGRAM

3.1     ISSUING AUTHORITY

          The President, National Power Corporation, may issue an authority for the development of an

          agricultural livelihood project upon the recommendation of the Manager, Watershed 

          Management Department.

2.1        QUALIFIED APPLICANTS

          The following may be qualified to apply for the Upland Agricultural Livelihood Program inside 

           the areas mentioned in Section 2.0.

2.1.1            A bonafide resident of the community since 1983 residing near, adjacent to or surrounding the area desired to be developed into an

                    agricultural area.

2.1.2            An individual of at least 21 years of age, Filipino citizen, with no pending criminal charge and must be “capable to develop and

                   manage an upland agricultural livelihood project.

2.1.3            He/She must be a head of the family and has no other source of income of not more than P2,000.00 a month.

2.1.4            Owner/s of titled lands or his/her authorized representative/s.

2.1.5            Owners of titled lands or his/her authorized representative.

2.1.6            Duly organized upland farmers organization or cooperative registered with the Securities and Exchange Commission.

 

3.3       REQUIREMENTS

0.1.1            Duly accomplished application form;

0.1.2            Location map of the area applied for with complete technical description;

0.1.3            Clearance from the NPC of the site applied for with complete technical description;

0.1.4            Inspection report jointly undertaken by the applicant and WMD or its authorized representative;

0.1.5            Application fee of P20.00 per application;

0.1.6            Inspection fee of P15.00 per hectare or a fraction thereof;

0.1.7            Proof/Certification that applicant is technically capable to develop and manage an agricultural farm issued by the Barangay Captain

                   where he is a resident; and

0.1.8            Submission of a project plan as stated in Section 3.6.1

 

  3.4     PROCEDURE

 

3.1.1            After submission of all the requirements to the NPC-WMD, the Head Office Staff, shall evaluate the merits of the application and

                   make necessary recommendations.

3.1.2            The Manager, NPC-WMD, makes the final decision on the matter within two months after submission of the application.

 

3.5       AVAILABLE AREAS

3.5.1            Brush lands or tracts of forest lands below 18% slope, generally covered with brush, which are not subject to reforestation within

                   the next five years;

3.5.2            The Manager, NPC-WMD, makes the final decision on the matter within two months after submission of the application.

3.5.3            Areas stated in 3.5.1 and 3.5.2 must not be located at the immediate banks of the reservoir or river tributaries.

 

3.6       AREA AND TENURE

 

3.6.1            The size of an area which may be subject to Upland Agriculture Livelihood Program shall be as follows:

                3.6.1.1     For individuals – not more than (3) hectares.

 

3.7      CONSERVATION/PROTECTION MEASURES

           The grantee shall:

3.7.1            Develop the area based on a development/management plan approved by NPC-WMD;

3.7.2            Delineate/Demarcate the area with markers such as trees or green breaks which shall be installed on corners and prominent points

                   along the boundary;

3.7.3           Not undertake any cutting of timber, unnecessary under brushing, forest floor clearing and burning or gathering of any other forest

                   products or undertaking of any activity not consistent with the purpose of the authority granted;

3.7.4           Bench terrace or contour sloping areas. Bench risers on contour paddies shall immediately stabilized by planting grasses ( i.e., star

                  grass, Napier grass ). At the same time, timber and or fruit trees shall be planted on the benches or between contour paddies.

                   Diversified cropping and organic fertilization is preferred;

3.7.5           Protect the area from destructive land uses/activities such as: illegal occupancy, uncontrolled burning, etc., causing

                  detrimental impacts on soil, water and other watershed resources;

                        3.7.6           Preserve the area for its natural characteristics/attributes;

3.7.7           Limit soil tillage to SALT practices whenever applicable. Intensive soil preparation using mold board plows and other farm

                  implements shall not be allowed;

3.7.8           Refrain from establishing permanent or semi-permanent structures within the area;

                        3.7.9          The grantor reserves the right to terminate the agreement in case the area will be explored for geothermal and other sources

                                          of energy. The grantee shall always make  the area available for energy and geothermal exploration.

           3.7.10      Perform other necessary conservation/protection measures that NPC-WMD may require.

                      3.8      ORGANIZATION/LINKAGES

                           When so required by NPC-WMD, at least fifteen (15) persons shall organize themselves into a farmers organization.

                           The Organization shall:

3.8.1         Have a Constitution and By-Laws

3.8.2         Link with the Barangay Captain who has the administrative jurisdiction over the area. The Barangay Captain shall be actively involved

                in the affairs of the organization.

3.8.3         Have its own set of officers duly elected by the general membership with specific function and responsibilities; and

3.8.4        Closely coordinate with NPC-WMD on matters affecting their organizations role and responsibilities in carrying out the herein stated

                terms and conditions.

 

3.9       RENEWAL OF PERMIT

3.9.1            An Upland Agricultural Livelihood Program Agreement may be renewed upon an application duly filed and the necessary

                   requirements complied with only if the area is not included in the Five (5) Year Reforestation Plan; and

3.9.2            A permit to develop an agricultural plantation may be renewed upon filing of an application sixty (60) days before its expiration and

                  completion of necessary documents.

SECTION 4.0      CRIMINAL OFFENSES AND PENALTIES

2.1        Illegal cutting and harvesting, gathering or transporting of forest products shall be punished in accordance with the provisions of Ministry Order No. 83-01-13 and other appropriate laws. Confiscated or seized forest products shall be impounded at NPC-WMD designated areas.

2.2        Illegal occupancy, cutting and transporting of forest products shall be punished accordance with the provisions of Ministry Order No. 83-01-13 and other appropriate laws.

2.4        Authorization/Permits issued under this order/regulation may be revoked, cancelled and/or suspended for any violation of the terms and conditions of this permit and other applicable laws and regulations.

SECTION 5.0      EFFECTIVITY

 

                This Memorandum Order shall take effect this ______day of ________________________ year 1995.

HOW TO APPLY

1.        Interested persons/individual must apply at the NPC-WMD office who has jurisdiction over the                

        watershed area.

2.        NPC-WMD Staff will determine if the area applied for is included in the five year reforestation plan. If the area will be cleared by NPC-WMD, applicant will be advised to submit the following documents:

a.         A certification from the Barangay Captain that the applicant is a bonafide resident of the area since 1983.

b.        A Farm Management Plan shall be submitted for evaluation by NPC-WMD Staff.

c.       Original copies of tax declaration or Transfer Certificate of Title (TCT), if any.

d.       Birth Certificate

e.       Income Tax Return of the preceding year.

3.        NPC-WMD field unit will survey and prepare the technical description of the area.

4.        The Manager, NPC-WMD will approve or disapprove the application depending on its merits and demerits.

PRIMER ON UPLAND AGRICULTURAL LIVELIHOOD PROGRAM

1.        What is the Upland Agricultural Livelihood Program ( UALP )?

        The Upland Agricultural Livelihood Program of the National Power Corporation is aimed at 

       augmenting the income of people dependent on the forest for livelihood and at the same time encourage 

       them to support our forest protection program.

2.        What are the objectives of the UALP?

        To promote forest conservation and protection among the forest occupants in watershed areas under

       EO 224 by providing occupants alternative sources of livelihood.

        To augment the income and livelihood of forest occupants.

        To be able to provide technical, educational and other community services to the occupants.

3.        What are the Policy Guidelines in the implementation of AL{?

        Tenure through an agreement shall be given for a period of five (5) years.

        Size of individual holdings shall cover an area of not more than three (3) hectares.

        Size of association/cooperative holdings shall cover and area of not more than twenty (20) hectares.

4.        Who may qualify as Beneficiaries of the ALP?

                A bonafide resident of the community residing near or adjacent to or surrounding the area desired to be 

              developed into agricultural area.

                An individual of at least 21 years of age, with a monthly income of not more than P2, 000.00.

                Owners of titled lands within the watershed and holders of tax declarations.

                An association or cooperative duly organized with Securities and Exchange Commission.

5.        What are the obligations and responsibilities of the beneficiary/grantee?

        Plant a minimum of 100 trees per hectare, with at least 20% of which are fruit bearing trees.

        The grantee shall not cut or remove any standing, healthy tree in the area, not even for the reason of

        expanding the cultivable area.

        To cultivate the area according to the SALT system of upland farming.

         Protect and conserve the forest resources as well as preserve markers and monuments.

                 The grantee shall not take in residence in the area nor construct permanent structures. Only farm sheds   

                shall be constructed.

6.        What happens if a grantee dies or is incapacitated?

        In case the grantee dies or incapacitated before the expiration of the contract/agreement, his rights and 

       privileges shall pass onto the grantees next-of-kin who shall work on and develop the land in accordance 

       with the terms and conditions of the contract/agreement and for the remaining unexpired term. 

7.        What is meant by next-of-kin?

                The term “next-of-kin” refers to the legitimate spouse and children, if not applicable, parents and

               brothers or sisters of a forest occupant who has entered into an ALP contact agreement.

8.        What areas are available under the program?

                Open and denuded areas, grasslands not scheduled for reforestation by NPC-WMD for the next five

               years from the date of issue of the ALP agreement.

                Titled lands and areas under tax declarations as long as no standing and healthy trees shall be cut and

               removed from the area for this purpose.

9.        What are the limitations with respect to the lands to be developed under the UALP?

                Continued occupancy of the area would result in soil erosion, sedimentation of rivers and streams,

               reduction in water yield, and destruction of other resources to the detriment of the community and 

               public interest.

                The area occupied will be subject to reforestation and other rehabilitation programs.

                The area will be explored for energy development.

10.     How big an area may a participant occupy under the program?

                For individual program participants, land shall not exceed three hectares.

                For associations or cooperatives, the land shall not exceed twenty hectares.

11.     What are the benefits that a grantee gets from the UALP?

                All income/proceeds derived from the land shall accrue to the participants.

                Technical, legal, financial, marketing and other needed assistance shall be extended to the participants.

KASUNDUAN SA PANGANGASIWA

 

 

                Ang KASUNGDUANG ito na ginawa at pinagkayarian ngayong _________ araw ng __________________________, 19_______ sa panig ng National Power Corporation na kinatawan ni Ginoo Edmund P. Anguluan, na Tagapamahala ng Watershed Managent Department ng National Power Corporation, na ditto ay tutukuying NAGKALOOB at __________________________________________ (pangalan), nasa hustong taong gulang, Pilipino, naninirahan sa ___________________________________________________

Na dito’y tutukuying PNAGKALOOBAN.

 

 

PINAGKALOOBAN

                Sapagkat ang PINAGKALOOBAN ay pinapayagang magsaka ng pambayang lupaing gubat sa ilalim ng batas ng Republika ng Pilipinas na pinagtibay ng Executive Order No. 83-01-13 at nakapagharap sa National Power Corporation ng pahintulot para bungkalin ang isang sukat ng lupang gubat na dito’y inilalarawan;

                Sapagkat, batay sa pinagiingatang mga opisyal na talaan ng NAGKALOOB, walang anumang iniharap na salungat na paghahabol, ano mang pagtutol o di pagsangayon laban sa kahilingan ng PINAGKALOOBAN.

                Sa gayon, alng-alang sa mga sinunduang saligan, ang PINAGKALOOBAN, ay binigyang karapatan ng NAGKALOOB, sa ilalim nitong KASUNDUAN SA PANGANGASIWA na linangin, pamahalaan at pangasiwaan ang sukat ng lupaing gubat na inilalarawan ng kalakip na mapa, na dito’y tutukuying “ang lupain” saklaw ng umiiral na batas, patakaran, alituntunin at regulasyon sa pag-gugubat at sa mga sumusunod na tadhana at kondisyon.

 

A.     PAGKABISA AT TANING

Ang kasunduang ito ay magkakabisa sa sandaling ito ay pagtibayin ng magkabilang panig at iiral sa loob ng limang taon na magwawakas sa __________________________________________.

 

B.      MGA KARAPATAN NG PINAGKALOOBAN

Ang PINAGKALOOBAN ay may karapatang matiwasay na bungkalin nang pansamantala ang lupain at tamasahin ang mga pakinabang ditto; may karapatang pamahalaan at trabahuin ang lupain alinsunod sa mga naaangkop na pamaraan at kasanayan sa paggugubat at pagsasaka;

Sakaling mamatay o mabalda ang PINAGLKALOOBAN bago magwakas ang kasunduang ito, ang mga karapatan at pribiliheyo na magmumula rito ay malilipat sa kanyang mga tagapagmana na pinakamalapit na kamag-anak, na siyang gagawa at lilinang sa lupain alinsunod sa itinatadhana nitong kasunduan ng pangangasiwa.

Sakaling pawalng bisa itong KASUNDUAN SA PANGANGASIWA, ang NAGKALOOB ay walang pananagutan sa PINAGKALOOBAN.

 

C.     MGA HAKBANG NA NAUUKOL SA PANGANGALAGA NG KAPALIGIRAN

Ang PINAGKALOOBAN ay mahigpit na susunod at/o magsasakatuparan sa mga hakbang na nauukol sa pangangalaga ng kapaligiran.

Ang PINAGKALOOBAN ay mananagot sa pangangalaga at konserbasyon sa mga tumutubong punungkahoy sa lupain at makipagtulungan sa National Power Corporation sa pangangalaga ng mga kagubatang karatig nito.

Ang PINAKKALOOBAN ay pangangalagaan ang mga mujon at iba pang palatandaan sa sakop na lupain na nagpapakita sa mga panulukan at hangganan.

Ang PINAGKALOOBAN ay hindi maaaring magbungkal ng lupa sa magkakaroon ng malawakang paghahawan atpagpupulbos ng lupa na paayon sa dalisdis ng lupa dahil ito’y pinagsisimulan ng pagguho ng lupa.

Ang PINAGKALOOBAN ay hindi puputol ng mga murang punongkahoy hanggang sa layong dalawampung metro (20) mula sa magkabilang tabi ng mga pampang ng sapa, ilog o batis na nakahangga o bumabagtas sa lupain.

Ang PINAGKALOOBAN ay pipigilin at susugpuin ang mga di-pinahihintulutan o di-pinangangasiwaang pagsusunog sa lupain o ibang lugar na karatig nito, at kung kinakailangan tutulong sa National Power Corporation sa pagpatay sa mga sunog sa kagubatan na sakop sa kagubatan na sakop ng lupain.

Ang PINAGKALOOBAN ay magtanim ng isandaang (100) punongkahoy man lamang ang beinte porsiyento nito ay nakakain ang mga bunga sa bawat ektarya na lupain upang magsilbing pagkain ng mga galang hayop sa gubat.

Ang PINAGKALOOBAN ay ipinagbabawalang magtayo ng permanenteng bahay, kundi damara lamang na gawa sa pawid at kawayan ; at ipinagbabawal ang pagtitira at pagtayo ng mga permanenteng mejora sa loob ng lupain.

Ang NAGKALOOB ay may karapatang ipawalang-bisa ang kasunduang ito kung sakaling ang lupa ay kakailanganin para sa pagtuklas ng mga panggagalingan ng enerhiya.

 

D.     MGA PANGKALAHATANG TADHANA

Lilinangin ng PINAGKALOOBAN ang lupain sa pamamagitan ng pagtatanim o pag-aalaga ng magkakasamang pananim, punungkahoy at halamang gubat ng sabay-sabay o sunod-sunod upang mapaunlad ang produksyon ng lupain.

Lalahok ang PINAGKALOOBAN sa paghahanda ng ‘‘Plano para sa Pamamahala ng Proyekto’’ ay lupain at tutulong sa pagtatayo ng ‘‘ Agro-Forestry Nursery’’ para sa lupain.

Sa pamamagitan nito’y nangangako ang PINAGKALOOBAN na linangin ang walumpung porsiyento (80%) man lamang ng lupain taun-taun upang matiyak ang lubos na alinsunod sa ‘‘Plano ng Pamamahala ng Proyekto’’.

Ang kasunduang ito sa pangangasiwa ay di-malilipat. Walang sinumang PINAGKALOOBAN ang pahihintulutang manghawakan ng mahigit sa Kasunduan sa Pangangasiwa sa alin mang panahon.

Ang PINAGKALOOBAN ay hindi dapat magpatrabaho sa ibang tao siya mismo ang dapat bumungkal sa lupain gayunman, maari niyang katulungin ang kanyang pamilya at umupa ng mga kakatulunging tao sa mga gawain na nangangailangan nito.

Hindi dapat paupahan ng PINAGKALOOBAN ang lupain o alinmang bahagi nito.

May karapatan ang NAGKALOOB na ipahintulot kung nauukol sa kapakanang pambayan ang pagbubukas ng mga bahagi ng lupain upang maging daanan; sa pagsubali, na ang mga tao o samahan na pahihintulutang dumaan sa bahaging iyon ay magbabayad sa PINAGKALOOBAN ng katamtamang halaga/kabayaran sa anumang pinsala sa mga mehora.

Ang NAGKALOOB  at PINAGKALOOBAN ay dapat tumalima sa iba pang kaugnay na batas, alituntunin at patakaran na maaaring ipahayag pagkatapos bilang pagtalima sa pagsasakatuparan ng Panlipunang Programa sa Panggugubat.

Ang NAGKALOOB at ang PINAGKALOOBAN ay sumasangayon ding tumatalima sa mga sumusunod na kondisyon.

E.     PAGWAWAKAS/PAGKANSELA NG KASUNDUAN

 Ang sumusunod ay mga batayan sa pagwawakas/pagkansela ng Kasunduan.

 

Kapag ang PINAGKALOOBAN ay hindi nakasunod sa mga tadhana at kondisyon nito sa loob ng anim (6) na buwan pagkaraang nakasulat na patalastasan ng NAGLAOOB hinggil sa pagpapabaya niya.

 

Mabigat at/o patuloy na paglabag sa batas, alituntunin at patakarang panggubat sa paglilinang ng lupain, at;

 

Kapag hinihingi ng kapakanang pambayan sa pagpapasiya ng Presidente, National Power Corporation.

 

G.     MGA INSENTIBO

 Makakatanggap ang PINAGKALOOBAN ng mga tulong pang-tekniko at mga dagdag na paglilingkod na nauukol sa paglilipat ng teknolohiya sa pagpaunlad, pag-aani at pagsasapamilihan at maaaring matanggap din ng tulong na gamin g mga binhi at punla mula sa Watershed Management Department, National Power Corporation at sa iba pang tanggapan ng pamahalaan.

 

Ang lahat ng kita/pakinabang sa lupain ay mapupunta sa PINAGKALOOBAN.

 

Ang mga produktong gubat na kinuha at/o inani sa lupain ay libre sa mga kabayarang panggubat.

 

H.     PAGPAPATIBAY

 Ang Kasunduang ito ay isang mahalagang bahagi ng Kasunduan ng Pangangasiwa at ang mga tadhanang nagsasaad dito ay ipinaliliwanag ng NAGKALOOB sa wikang maiintindihan ng PINAGKALOOBAN bago nilagdaan ang kasunduan.

 

Ang NAGKALOOB at ang PAINAGKALOOBAN ay dapat lumagda sa bawat pahina ng Kasunduang ito. (sakaling hindi marunong sumulat ang PINAGKALOOBAN , dapat niyang itatak sa Kasunduan ang marka ng kanyang hinlalaki kapalit ng lagda niya).

 

BILANG PAGPAPATUNAY, ang naturang mga panig ay lumagda rito ngayong _____________, araw ng ______________________________, 19________., sa ___________________________________________.
